PRIVACY POLICY

Property Owners Protection Insurance Company, LLC (“POPIC” or “we”) collects and uses personal information (“Information”) about individuals, including clients, prospective clients, and individuals who enter into contracts (primarily leases) with our clients (“you”).  We are committed to your privacy – to handling the information we collect with care and complying with applicable privacy and data protection laws. In connection with our privacy practices, note that:

  • We collect and, where needed, disclose information solely to enable the lawful conduct of our business and not for any other reason
  • We do not sell products or services directly to individual consumers
  • We have not sold and do not sell any of the Information we collect

INFORMATION WE DO AND DO NOT COLLECT

We collect different types of information depending on our relationship with you.  Generally speaking, we collect information related to (i) clients and prospective clients, who are, for the most part, property owners and property managers (sometimes referred to herein as “Landlords,” whether or not they qualify as a landlord under applicable law in any particular jurisdiction), and (ii) tenants of our clients, that is, individuals who have entered into a lease agreement for residential housing that is owned or managed by a client.

Clients and Prospective Clients

For clients and prospective clients, we collect from you information related to individuals and their business(es), which can include publicly available contact details, current and historical; identifying details, including dates of birth; government identification numbers, including social security numbers; tax identification numbers, including employment identification numbers; professional activities, current and historical; interactions with government authorities; and financial details, including account numbers.

For clients and prospective clients, we also collect information from third parties consisting of publicly available contact details and professional activities.

For clients and prospective clients, we do not collect credit card numbers or health related information.

Tenants of our Clients

For tenants of our clients, we collect from you a subset of the information we collect for clients and prospective clients, and additional information besides.  This can include publicly available contact details and renters insurance policy numbers and terms.

For tenants of our clients, we also collect information from third parties.  Typically, this information is collected from third parties such as property owners, property managers, and leasing agents (“Landlords”) with whom tenants have an existing relationship or are in the processing of entering into one.  The Information we may receive from your Landlord is the same as the information we collect from you, as well as lease agreement terms; leasing history; and incident details related to claims activity.

For tenants of our clients, we do not collect information such as social security numbers, driver’s license numbers, credit card numbers, financial account numbers, or health related information.

WHAT WE DO WITH YOUR INFORMATION AND WHAT WE DISCLOSE

We use different types of information in different ways, depending on our relationship with you.

Clients and Prospective Clients

We use your information in conformity with applicable law to provide the services for which you have contracted with us, to determine the nature of our business relationship with you, and to help us identify which of our services may be suitable for you, and to comply with legal obligations for record-keeping.

We disclose your information in conformity with applicable law as follows:

  • To government authorities, for the purpose of (i) applying for licenses, permits, certifications, or authorizations (“Licenses”) that you seek for the purposes of conducting business and (ii) maintaining compliance with applicable laws, rules, and regulations
  • To third party service providers, such as actuaries, accountants, lawyers, and third-party administrators, to facilitate the conduct of your business
  • In response to court orders, subpoenas, or similar governmental requirements
  • To defend our legal rights and the rights of our officers, employees, and customers

We may use your information to contact you directly in relation to services that we offer.  We do not sell your information.

Tenants of Clients

We use your information in conformity with applicable law to determine whether your third-party renters insurance policy complies with your Landlord’s requirements for such policies and to provide services directly to your Landlord for which your Landlord has contracted with us.

We disclose your information in conformity with applicable law as follows:

  • To Landlords, in relation to your third-party renters insurance policy and whether it complies with your Landlord’s requirements for such policies
  • To third party administrators, to facilitate the handling of claims
  • In response to court orders, subpoenas, or similar governmental requirements
  • To defend our legal rights and the rights of our officers, employees, and customers

We may use your information to contact you directly to assist in determining whether your third-party renters insurance policy complies with your Landlord’s requirements for such policies.

We do not sell products or services directly to individual consumers and we will not contact you for that purpose.  We do not buy or sell your information.

ADDITIONAL INFORMATION FOR WEBSITE USERS

We maintain several different websites and portals (“sites”) in connection with our business, and collect information through these sites.  We, or the third parties that provide functionality, may collect certain information automatically when you visit these sites, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, internet service provider (ISP), the date and time of your visit, information about the links you click, the pages you view, the general manner in which you navigate the site, and other standard server log information.  We may also collect automatically certain location information when you use these sites, such as your computer’s IP address, your mobile device’s GPS signal, or information about nearby WiFi access points and cell towers.  We and third parties that provide content or functionality for our sites this sit may use cookies, pixel tags, Local Shared Objects, and similar technologies to automatically collect this information.

We do not make use of the information collected automatically as described in the previous paragraph.  We do not sell such information.

Tenants of our clients may access a confirminsurance.com site for the purpose of providing an insurance policy in conformity with the requirements of the lease between the tenant and the Landlord.  In so doing, tenants provide, and we collect, publicly available contact details and renters insurance policy numbers and terms, as well as copies of such policies (or related documents, such as binders) that you upload.

CONFIDENTIALITY AND SECURITY

Information that you provide us through one of the confirminsurance.com sites or portals is encrypted through a signed SHA-256 TLS (Transport Layer Security) certificate.  This protocol, which creates a secure connection between your browser and the servers we use, is an industry standard used by many websites for submitting personal information.  Regardless of source, information is stored on servers with a range of security features (e.g., firewalls, encryption), and accessed within secure environments by personnel who need such access in order to carry out our business functions.  Servers and environments in which information is stored are monitored for unauthorized intrusion and subject to regular security updates as part of our effort to safeguard information in our care, custody, or control.

CALIFORNIA RESIDENTS

Under the California Consumer Privacy Act (“CCPA”), California residents have the following rights: (1) the right to know, which is the right to request that we disclose information about, or a copy of, the types of personal information we collect, use, and disclose about them; (2) the right to delete, which is the right to request that we delete personal information that is collected or maintained by us; and (3) the right to non-discrimination, which is the right to be free from discrimination for exercising any consumer rights under the CCPA. We may limit our responses to any requests under the CCPA as permitted by law. For example, we need to maintain certain information to provide our services to you or for legal and compliance purposes.
